Returns
"You" means the company, firm, body or person purchasing the "Goods".
"Goods" means the Goods (including any instalment of the Goods) which Newcastle Falcons will supply in accordance with these conditions.
"Newcastle Falcons" means Newcastle Rugby Football Club Limited including the Newcastle Falcons Shop, registered address, Kingston Park, Kenton Bank Foot, Newcastle Upon Tyne, NE13 8AF
Delivery and Risk
The Goods and Order will be delivered to the address You give when You place your Order.
If delivery cannot be made to your address, Newcastle Falcons will inform You as soon as possible, and refund or re-credit You for any sum that has been paid by You or debited from your credit card for delivery.
If delivery of Goods requires a signature from someone at your address to acknowledge receipt and there is no one at the address given who is competent to accept delivery of the Goods, You will be notified of an alternative delivery date or a place to collect the Goods.
Every effort will be made to deliver the Goods as soon as possible after your Order has been accepted and in any event within 30 days of Newcastle Falcons confirmation of your Order. However, Newcastle Falcons will not be liable for any loss or damage suffered by You through any reasonable or unavoidable delay in delivery (for example as caused by circumstances Newcastle Falcons reasonable control). In this case, Newcastle Falcons will inform You as soon as possible of the circumstances.
You will become the owner of the Goods You Ordered and responsible for risk of loss of or damage to them once they have been delivered to You. This will remain the case in respect of any Goods which You return to us under these terms until such time as Newcastle Falcons has received them back.
Cancellations, Returns and Exchanges
You have the right to cancel the Contract at any time up to the end of seven workings days after You receive the Goods (see below). A working day is any day other than weekends and bank or other public holidays.
To exercise your right of cancellation, You must give written notice to the Newcastle Falcons Shop by hand or post, fax or e-mail, at the address, fax number or e-mail address shown on the Website, giving details of the Goods Ordered and (where appropriate) their delivery.
If You quickly inform us of your intention to cancel your Order we may be able to amend your Order before the Goods have been dispatched to You. If You exercise your right of cancellation after the Goods have been delivered to You, You will be responsible for returning the Goods to Newcastle Falcons at your own cost. (You will not have to pay for the return of Goods sent to You in error or Goods which are deemed faulty in accordance with information contained herein). The Goods must be returned to the address shown on the Website. You must take reasonable care to ensure the Goods are not damaged or lost in the meantime or in transit. You should use a recorded delivery service or similar one that requires a receipt where we have sent Goods to You by this method.
Once You have notified Newcastle Falcons that You are canceling the contract as indicated above, Newcastle Falcons will refund or re-credit You within 30 days for any sum that has been paid by You or debited from your credit card for the Goods.
If You do not return the Goods as required, Newcastle Falcons may charge You a sum not exceeding the direct costs of recovering the Goods.
You do not have the right to cancel the Contract if the Order is for audio or video recordings or computer software which have been unsealed by You, or for Goods which by their nature cannot be returned or are liable to deteriorate or expire rapidly. Newcastle Falcons will notify You at the time of your Order if this applies.
If, having exercised your right to cancel an Order in accordance with this clause, You require alternative Goods, a completely new Order will need to be submitted. This will provide You with the best level of customer service and ensure that You can receive these alternative Goods as soon as possible without having to wait for us to receive and process your returned Goods. Please note however that, although Newcastle Falcons will make every effort to fulfill your new Order, as with any Order, Newcastle Falcons does not guarantee that the replacement items requested will be available due to possible stock shortages.
Warranty and Faulty Goods
All Goods supplied by Newcastle Falcons are warranted free from defects for 12 months from the date of supply. This warranty does not affect your statutory rights as a customer.
This warranty does not apply to any defect in the Goods arising from fair wear and tear, willful damage, accident, negligence by You or any third party, use otherwise than as recommended by the manufacturer or Newcastle Falcons, failure to follow the relevant instructions, or any alteration or repair carried out without the manufacturer's or Newcastle Falcons approval.
If the Goods supplied to You develop a defect while under warranty, or You have any other complaint about the Goods, You should notify the Newcastle Falcons Shop in writing at the address, fax number or e-mail address shown on the Website. Newcastle Falcons will only refund return postage costs if the Goods are deemed to be faulty and a receipt of postage is included with the returned Goods. Newcastle Falcons will notify You of any refunds via e-mail, subject always to your statutory rights.
Refunds after the expiration of the warranty period are only at the discretion of Newcastle Falcons.
